Debt

"Bankers dwell in marble halls,

To encourage deposits and deter withdrawals !!!"

Upon the high waters of the 21st Century modern economy few of us can avoid debt at some time in our lives – credit cards, store cards, personal unsecured loans, consumer credit agreements, h.p., secured loans, student loans, utilities bills, Council tax bills, mortgages etc etc etc, all vital to the survival of our society, yet is seems the ‘never never’ never had so many faces to beguile us with.  And the pitfalls for the unwary or simply just the unfortunate are deeper than ever.

The old ‘poindings and warrant sales’ may have been abolished on paper, but as soon as the Scottish Parliament had voted in the Abolition of Poindings & Warrant Sales Act, the Executive was busy in devising a new method of debt enforcement – the attachment order, which is in some important respects even harsher for the ill advised debtor.

And as the housing market spirals ever upwards, more and more of us find ourselves in difficulties over mortgage payments and facing potential repossession.

Bankruptcy too is on the up and up, with sequestration for Council tax arrears being a particular bete noir at this time of year.

Yet help is at hand.

LSA’s court department consists of a team of seven lawyers and one paralegal who can advise on many aspects of debt from preventative measures to the available options for dealing with the out of hand situation, whether it be self-sequestration, Protected Trust Deed, Debt Arrangement Scheme, remortgage etc*.  We may also be able to offer representation in court.

Brown & Co, Solicitors, at LSA, is authorized by the Law Society of Scotland to provide incidental financial advice. It would not normally be within our remit to advise on financial products.  We are not authorised to administer PTD or DAS but may be in a position to refer on.
